didn't Foul hide very near to Earthroot after TPTP for 3 thousand years? I seem to remember stlt from the beginning of TWL. this also indicates that he could somehow tap into EP

For when Covenant had defeated the Despiser, reduced him by wild magic and laughter to a poverty of spirit so complete that he could no longer remain corporeal, the Despiser had not died. Despite did not die. Fleeing the destruction of his Creche, he had hidden at the fringes of the one power potent enough to heal even him: the Earthpower itself.

Kinda difficult to figure out what Foul could and could not do with Earthpower.

Trell's low-grade RoD would seem to say so, I would assume. It may not be part of Kevin's Wards, but it's Earthpower, and Earthpower lends itself to either construction or destruction, with no consideration of the Oath.
