Rdhopeca,

Point two is out of date. The Supreme Court overruled the 7th Circuit on the search of Cell Phones. Police now need a warrant to search a cell phone.

Good luck with that. During an arrest I am certain the police are going to confiscate the cell phone and search it anyway using the justification "we had to make sure there were no messages sent to or from other criminal elements". This presumes that the cell phone isn't "lost" during the arrest process when they bag and tag your property.
